THE POWERMATIC WARRANTY

1st CONDITIONS OF SALE AND WARRANTY

The current conditions of sale and warranty supersede the previous ones. These will apply to all orders and sales of materials and/or services contracted with our company POWERMATIC SEGURIDAD S.L.Unip, from now on Powermatic. We understand as CLIENT the person and/or company that, based on their rights, order the work or services requested from our company.

All Powermatic equipment is carefully previously selected to guarantee its products and services. The warranty duration for completely new equipment or installations is 36 months from the date of sale. All products will remain the property of Powermatic until full payment for services performed.

The warranty includes the repair or replacement of the product found to be defective at the discretion of Powermatic. Any other expense borne by the Client is excluded from the guarantee. The Client agrees not to modify or install additional equipment that may alter its correct functioning, without prior information and written validation to Powermatic management. Otherwise, the guarantee would be void.

2nd CONFIRMATION AND VALIDITY OF BUDGETS.

The validity of the offers presented is THIRTY DAYS from their completion. We ask that if you wish to accept the offer received, and if you agree with both the prices offered and the payment conditions described, you send us this signed document as proof of acceptance, either through mail, email or mobile messaging. to avoid any type of doubt or misunderstanding.

3rd FORM OF PAYMENT

The only valid payment method would be the one agreed upon by both parties, detailed and signed in the accepted budget in both its form and amount. In the event of delay or non-payment in part or all of the due dates, Powermatic will be entitled to charge the default interest payable by the CUSTOMER as established by Royal Legislative Decree No. 231 of 10/9/2001. In the event of non-payment Powermatic may withdraw the materials or services installed until payment is completed in full.

4th WARRANTY

4.1 The warranty period for new installations is 36 months from its sale and/or installation. The warranty includes repair or replacement, transportation and travel necessary for coverage. Powermatic has the complete right to repair or replace the materials under warranty at the discretion of its technicians.

4.2 The warranty will be covered on materials sold over the counter by visiting our facilities. If the displacement of a technician is necessary, the cost of said service will be charged according to the current rates of our company.

4.3 The warranty period for repairs in cases of products or installations outside the original warranty period will be as established by the Consumer Law in Europe, 3 months for both replaced or repaired materials, in accordance with existing regulations.

4.4 Batteries for motors, transmitters, or any other type of access control or communication devices have a 6-month warranty from the date of purchase; as long as it is accompanied by proof of sale of the mentioned item.

4.5 In no case will the guarantee cover requests for unpaid or pending work.

4.6 Failures or breakdowns caused by the integration of equipment from other companies will not be covered. An example is the connection to automation of new opening elements such as receivers, access controls, electronic intercoms and/or home automation control equipment if they have not been previously reported.

4.6  Any type of regulation or adjustment that is necessary as a result of obstacles in the area or ground movements will never be covered as a guarantee. The assistance requested to adjust engine work times, break time is not considered a guarantee and will be invoiced as it is not considered equipment failure.

5th MAINTENANCE

5.1 AUTOMATION IN GENERAL.

All automatic door and automation systems require periodic and scheduled maintenance. This maintenance is necessary both for the safety of users and for the proper functioning and greater durability of the equipment. Along with the invoice, you must have received the use and maintenance manual, otherwise you can request it at any time at our facilities or by emailing sat@powermatic.es. The absence of regular and justified maintenance completely invalidates the official warranty. This maintenance is not free and must be requested by the client for its correct application.

5.2 ACCESS CONTROLS.

Electronic opening and closing devices such as keys, remote controls and proximity cards, for greater security, require external data storage. The maintenance of these databases on the servers has an annual economic cost that will be passed on, especially to neighborhood communities and large facilities. The cost of this service may vary, which is why we recommend that you inform yourself about it in advance.

6º OUT OF WARRANTY

Powermatic does not assume any responsibility for problems or breakdowns resulting from misuse of the products. Users must always respect the rules of use and the appropriate capacity for use. Powermatic does not respond to failures in products and installations that are subsequently connected to other devices not installed by our company.

Under no circumstances will expenses caused by the following reasons be covered by the warranty.

6.1 Lack or failure of electrical power in the equipment.

6.2 Lack or failure of internet connection of the equipment.

6.3 Theft, fire, damage caused by the entry of water or humidity into the equipment.

6.4 Damage to wiring or equipment caused by insects, rodents or any other type of animals.

6.5 Adjustments, regulations or cleaning of the equipment necessary for its correct use and maintenance.

7th SPANISH LAW AND COMPETENT JURISDICTION.

For any controversy that may arise in the execution of the current contract between both parties, by agreement they submit to the exclusive jurisdiction of Spanish Laws, and exclusively to the Courts of Marbella.
